Terms of Service

1. Acceptance

By downloading, installing, or using Vietnamy (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. Vietnamy is operated by TECXMATE Corporation Ltd. (“we”, “us”).

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

  • Keep your credentials confidential; you are responsible for activity on your account.
  • Provide accurate information and keep it current.
  • We may suspend or terminate accounts that violate these Terms.

4. Subscriptions & Billing

  • Vietnamy offers optional paid subscriptions unlocking additional lessons and features.
  • Payment is charged through the App Store or Google Play at confirmation.
  • Subscriptions auto-renew at the end of each period unless canceled at least 24 hours before renewal via your App Store or Google Play account settings.
  • Refunds are governed by the store’s refund policy, not by us directly.
  • Prices may change; we will notify you before a renewal at the new price.

5. Free Trials

If we offer a free trial, you will be charged at the end of the trial period unless you cancel before it ends. Trial availability may be limited to first- time subscribers.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code.
  • Circumvent access controls, rate limits, or usage restrictions.
  • Use the Service to send unlawful, harassing, hateful, or infringing content, including through the AI Tutor.
  • Resell, redistribute, or use the Service to build a competing product.
  • Attempt to overload or disrupt our infrastructure.

7. AI Tutor Disclaimer

The AI Tutor generates responses using a large language model. Output may be inaccurate, incomplete, or outdated and must not be relied on for legal, medical, financial, safety-critical, or official translation purposes. You are responsible for verifying important information independently.

8. Intellectual Property

  • Vietnamy content, curriculum, dictionary entries, code, and branding are owned by TECXMATE Corporation Ltd. or its licensors.
  • We grant you a limited, personal, non-transferable, revocable license to use the Service for your own learning.
  • You retain rights to content you submit (voice recordings, feedback). You grant us a limited license to process that content to provide the Service.

9. Third-Party Services

The Service integrates third-party services (Apple, Google, Firebase, OpenAI, Anthropic). Your use of those integrations is also subject to their respective terms. We are not responsible for third-party outages, changes, or content.

10. Termination

You may stop using the Service and delete your account at any time via Settings → Account → Delete Account, or by emailing nguyenvanqui291@gmail.com. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to us or other users. Sections that by nature should survive termination will do so.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability to you for any claim arising from or related to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim, or USD 50, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

13. Governing Law & Disputes

These Terms are governed by the laws of Vietnam, without regard to conflict of laws principles. Disputes will be resolved in the competent courts of Ho Chi Minh City, unless mandatory local law grants you the right to bring claims in your place of residence.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced at least 30 days before they take effect via in-app notice or email. Continued use of the Service after that date means you accept the updated Terms.
